DEFAULT HAVING BEEN MADE in the payment of the indebtedness secured by that certain mortgage executed by JOHN CHAMBERS and MARY CHAMBERS, the mortgagors, to THE CITIZENS BANK OF VALLEY HEAD, the mortgagee, which is dated December 29, 2008, and was recorded on December 30, 2008 at 10:39 a.m. in Mortgage Book 1578, Page 218 in the Office of the Judge of Probate, Dekalb County, Alabama; and said second mortgage which is dated March 5, 2010, and was recorded on March 11, 2010 at 10:19 a.m. in Mortgage Book 1642, Page 205 in the Office of the Judge of Probate, Dekalb County, Alabama;
AND DEFAULT CONTINUING, notice hereby is given that under the power of sale contained in said mortgage, I will, on behalf of Merit Bank, as successor in interest to The Citizens Bank of Valley Head, proceed to sell on September 8, 2020, during the legal hours of sale; to-wit: 11:00 o’clock a.m. to 4:00 o’clock p.m., in front of the main entrance door to the DeKalb County Courthouse in Fort Payne, Alabama, to the highest, best, and last bidder for cash, the following described real estate situated in DeKalb County, Alabama, and described as follows:
A tract or parcel of land containing 1.8 acres, located in the Northwest Quarter of the Northeast Quarter of Section 35, Township 5 South, Range 10 East, Huntsville Meridian, DeKalb County, Alabama, and more particularly described as follows:
Commence at a 1 ½ inch pipe found at the Northwest corner of said Section 35; thence North 89 degrees, 02 minutes, 18 seconds East along the North line of said section 3368.09 feet to a point which is 1964.36 feet from a 4 inch X 8 inch planted stone at the Northeast corner of said section; thence South 00 degree, 57 minutes, 42 seconds East, 436.68 feet to a 3 ½ inch pipe; thence South 03 degrees, 03 minutes, 58 seconds West, 249.69 feet to an iron set with yellow cap stamped OWEN 27400, the point of beginning; thence South 03 degrees, 03 minutes, 58 seconds West, 249.69 feet to a 3 ½ inch pipe; thence South 88 degrees, 48 minutes, 22 seconds West, 314.89 feet to an iron set with yellow cap stamped OWEN 27400; thence North 03 degrees, 03 minutes, 58 seconds East, 249.69 feet to an iron set with yellow cap stamped OWEN 27400; thence North 88 degrees, 48 minutes, 22 seconds East, 314.89 feet to the point of beginning.
ALSO:
A 10 foot wide non-exclusive easement for ingress, egress and utilities along an existing drive from the Southwest corner of said tract or parcel of land 318.99 feet to the East right-of-way limit of Bankhead Road (County Road 642).
Said sale is for the purpose of securing payment of the indebtedness secured by said Mortgage, together with the costs of foreclosure.
