Default having been made of the terms of the loan documents secured by that certain mortgage executed by Mary J King Single to Jim Walter Homes, Inc. dated April 1, 2005; said mortgage being recorded on April 26, 2005, in Book 1290, Page 120 in the Office of the Judge of Probate of De Kalb County, Alabama. Said Mortgage was last sold, assigned and transferred to U.S. Bank, N.A., as Trustee, successor in interest to Wachovia Bank, National Association, as Trustee, for Mid-State Capital Corporation 2005-1 Trust to be recorded in the Office of the Judge of Probate of De Kalb County, Alabama.
The undersigned, U.S. Bank, N.A., as Trustee, successor in interest to Wachovia Bank, National Association, as Trustee, for Mid-State Capital Corporation 2005-1 Trust, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash before the main entrance of the Court House in De Kalb County, Alabama during the legal hours of sale (between 11am and 4pm), on the 11th day of September, 2020 the following property, situated in De Kalb County, Alabama, to-wit:
Begin at the Northeast corner of the Mildred Walker lot and run East 570.4 feet to the westerly right of way line of Alabama State Highway No. 75; thence, run South 29’ 13’ West with said right of way line for 155.8 feet; thence, West to the Southeast corner of Mildred Walker Lot; thence North along the said Mildred Walker East line to the point of beginning; and containing 2.1 acres, more or less. Being and lying in the South half of the Northwest Quarter of Section 19, Township 6 South, Range 8 East of the Huntsville Meridian, in the Town of Rainsville, DeKalb County, Alabama.

A parcel of land in the Southeast Fourth of the Northwest Fourth of Section 19, Township 6 South, Range 8 East described as follows: Beginning at the Northeast corner of the Southwest Fourth of the Northwest Fourth of Section 19, Township 6, Range 8, run North 89 degrees 17 minutes East 449.1 feet to the Westerly right of way line of Alabama Highway No. 75 ( 100 feet right of way); to the point of beginning; thence run South 29 degrees 13 minutes West with said right of way line for 155.8 feet; thence run South 89 degrees 17 minutes West 316.01 feet; thence run North 0 degrees 43 minutes West 135.02 feet; thence North 89 degrees 17 minutes East 393.75 feet to the point of beginning.
Said property is commonly known as 123 White St NW, Rainsville, AL 35986.
Should a conflict arise between the property address and the legal description the legal description will control.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, all outstanding liens for public utilities which constitute liens upon the property, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, easements, rights-of-way, zoning ordinances, restrictions, special assessments, covenants, the statutory right of redemption pursuant to Alabama law, and any matters of record including, but not limited to, those superior to said Mortgage first set out above. Said property will be sold on an “as-is” basis without any representation, warranty or recourse against the above-named or the undersigned. The successful bidder must present certified funds in the amount of the winning bid at the time and place of sale.
