NOTICE OF MORTGAGE FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by certain mortgages executed by Troy Lee Kittle, Cheva N. Kittle and Wayne Kittle to Bank of Dade on the 15th day of July, 2008 and recorded in Mortgage Book 1554, at Page 107 in the office of the Judge of Probate of DeKalb County, Alabama, and these other mortgages executed by Troy Lee Kittle and Cheva N. Kittle to Bank of Dade recorded in Mtg Bk 2232, p. 10440, dated 8/31/2018, in Mtg Bk 2048, p. 101, dated 3/25/2014, in Mtg Bk 863, p. 236, dated 6/7/1999, in Mtg Bk 1057, p. 330, dated 8/8/2002, and in Mtg Bk 1683, p. 268, dated 1/21/2011.
Under and by virtue of the power of Sale contained in said mortgages, the said Bank of Dade will sell at public outcry, to the highest and best bidder for cash, in front of the courthouse in Fort Payne, DeKalb County, Alabama on the 19th, day of October, 2020, during the legal hours of sale, between 11:00 a.m. and 4:00 p.m., the following described real estate situated in
DeKalb County, Alabama, to-wit;
Beginning at the southwest corner of the NW 1/4 of the SW 1/4 of Section 7, Township 5 South, Range 9 East of the Huntsville Meridian, DeKalb County, Alabama and run North 00° 13’ 00” West with the west boundary line of said Section 7 for 423.57 feet; thence leaving said west boundary line run South 88° 53’ 08” East for 672.64 feet to a point on the southwesterly right-of-way line of Alabama State Highway No. 40 (100° R.O.W.); thence run South 30° 48’
43” East with said right-of-way line for 88.51 feet; thence leaving said right-of-way line run South 49° 39’ 51” West for 114.41 feet; thence run South 23° 02’ 36” West for 281.47 feet to a point on the south boundary line of the NW 1/4 of the SW 1/4 of said Section 7; thence run
South 89° 50’ 39” West with said south boundary line 518.77 feet to the point of beginning.
Said property is lying Section 7, Township 5 South, Range 9 East of the Huntsville Meridian, DeKalb County, Alabama. Less and Except that portion of right-of-way for a unpaved county road which runs along the south boundary line of the above described property. Containing 5.6 acres, more or less.
