ORDINANCE NUMBER 11-18-19
AN ORDINANCE WHICH SHALL BE ENTITLED,
“THREE PHASE BUILDING INSPECTION
ORDINANCE.”
BE IT ORDAINED BY THE CITY COUNCIL OF
RAINSVILLE, ALABAMA as follows:
1. Ordinance Number 11-18-19 hereby is entitled, “Three Phase Building Inspection Ordinance.”
2. It is the City’s desire to have and to promote quality construction within the city limits of Rainsville, Alabama, as the same protects the citizens of Rainsville, and promotes growth, reliability of workmanship, and the free flow of real estate transactions and commerce within the City.
3. Beginning on January 1, 2020, all new construction for which building permits are required within the City of Rainsville shall comply with this “Three Phase Inspection Ordinance.”
4. Anyone engaging in construction for which a building permit is required shall cause an inspection to be made of the project at such time as the foundation is laid, and then a second inspection shall be made prior to the dry wall being installed, and then a third and final inspection shall be made once construction is complete.
5. The purpose of the inspections shall be to ensure that the construction is performed in compliance with the standards of the International Residential Code of 2000
6. All inspections shall be performed by inspectors duly licensed and certified by the State of Alabama Building Commission.
7. Each person performing an inspection within the City of Rainsville, Alabama in accordance with this Ordinance shall cause a copy of his/her inspections, and his/her current license to be filed with the City of Rainsville Revenue Officer, who will be the custodian of such records for the City of Rainsville.
8. Once the final building inspection is completed and filed with the Revenue Officer, and all requirements of this Ordinance otherwise are met, then the City of Rainsville will issue a Certificate of Occupancy.
9. The Revenue Officer, and any other such persons as he may choose, shall have the right to visit the construction site for the purpose of observing the same to determine compliance with this Ordinance at such times as he determines reasonable.
10. In the event a construction project fails to comply with this Ordinance, then the City of Rainsville by and through its Revenue Officer shall have the authority to halt the construction pending compliance with the Ordinance, to file a complaint demanding a fine from the property owner upon which the construction is being performed up to $500.00, and each day the project fails to comply with this Ordinance shall be a separate violation. A complaint may be brought for Ordinance violation by the Revenue Officer, and shall be heard in the Rainsville Municipal Court.
