ORDINANCE ALTERING,
REARRANGING AND EXTENDING BOUNDARY LINES AND
CORPORATE LIMITS OF THE CITY OF RAINSVILLE, ALABAMA
WHEREAS, the boundary lines and corporate limits of the City of Rainsville, DeKalb County, Alabama hereby have been altered, rearranged, and extended to include within the corporate limits of the City of Rainsville, in addition to the lands now included, all of the following territory:
PARCEL A:
Autumn Creek Subdivision, more particularly described as follows:
Commence at an existing axle marking the southeast corner of the Southeast Quarter (SE 1/4) of the Northwest Quarter (NW1/4) of Section 15, Township 6 South, Range 7 East of the Huntsville Meridian and proceed South 89° 30’ 10” West for a distance of 200.00 feet to an existing iron pin with cap (PLS #11568), said point being the point of beginning;
Thence proceed South 89° 29’ 30” West for a distance of 1,133.56 feet to an existing iron pin with cap (Rymeg) marking the Southwest comer of the Southeast Quarter (SE 1/4) of the Northwest Quarter (NW 1/4) of said Section 15; thence proceed North 00° 19’ 30” West for a distance of 471.04 feet to an existing iron pin with cap (Rymeg) on the bank of South Sauty Creek; thence continue North 00° 19’ 30” West for a distance of 71.3 feet more or less to the center of South Sauty Creek; thence proceed in a Northeast direction with the meandering of the center of said creek for a distance of 492 feet more or less; thence leaving the center of said creek, proceed South 64° 20’ 35” East for a distance of 304 feet more or less to an iron pin set with cap (PLS #11568); thence proceed South 43° 22’ 55” West for a distance of 5.25 feet. to an iron pin set with cap (PLS #11568); thence proceed South 64° 20’ 35” East for a distance of 276.98 feet to an iron pin set with cap (PLS #11568); thence proceed North 25° 39’ 25” East for a distance of 5.00 feet to an iron pin set with cap (PLS #11568); thence proceed South 64° 20’ 35” East for a distance of 659.69 feet to an iron pin set with cap (PLS, #11568); thence proceed South 72° 54’ 30” East for a distance of 561.30 feet to a mag nail set on the centerline of Kirk Road; thence proceed South 58° 42’ 20” West with the centerline of’ Kirk Road for a distance of 77.26 feet to an existing railroad spike; thence leaving the centerline of said road, proceed North 72° 54’ 30” West for a distance of 489.24 feet to an existing iron pin with cap (PLS #23344); thence proceed South 27° 53’ 10” West for a distance of 422.97 feet to the point of beginning. Containing 21.83 acres, more or less.
PARCEL B:
Commence at an existing axle marking the Southeast corner of the Southeast Quarter (SE 1/4) of the Northwest Quarter (NW 1/4) of Section 15, Township 6 South, Range 7 East of the Huntsville Meridian and proceed South 89° 30’ 10” West along the South boundary of said Quarter-Quarter for a distance of 200.00 feet to an existing iron pin with cap (PLS#11568); thence leaving the South boundary of said Quarter-Quarter, proceed North 27° 53’ 10” East for a distance of 422.97 feet to an existing iron pin with cap (PLS#23344) on the East boundary of said Quarter-Quarter; thence leaving the East boundary of said Quarter-Quarter, proceed South 72° 54’ 30” East for a distance of 489.24 feet to an existing railroad spike on the centerline of Kirk Road (60 ft ROW): thence proceed South 58° 42’ 20” West with the centerline of said road for a distance of 438.06 feet to a point on the South boundary of the Southwest Quarter (SW 1/4) of Northeast Quarter (NE 1/4) of said Section 15; thence leaving the centerline of Kirk Road, proceed South 89° 30’ 10” West for a distance of 91.15 feet to the point of beginning.
SAID PARCEL OF LAND LYING IN THE SOUTHEAST QUARTER (SE 1/4) OF THE NORTHWEST QUARTER (NW 1/4) AND THE SOUTHWEST QUARTER (SW 1/4) OF THE NORTHEAST QUARTER (NE 1/4), ALL IN SECTION 15, TOWNSHIP 6 SOUTH. RANGE 7 EAST, DEKALB COUNTY, ALABAMA AND CONTAINING 3.08 ACRES MORE OR LESS.
PARCEL C:
Commence at an axle marking the southwest corner of the Southwest Quarter (SW1/4) of the Northeast Quarter (NE1/4) of Section 15, Township 6 South, Range 7 East of the Huntsville Meridian and proceed North 89° 24’ East along the South boundary of said Quarter-Quarter for a distance of 149.3 feet to a point in the Southeast Right-of-Way boundary of Kirk Road (60 ft. R.O.W.), said point being the point of beginning;
thence proceed North 58° 22’ minutes East along the Southeast R.O.W. boundary of Kirk Road for a distance of 388.5 feet to a point; thence proceed North 58° 24’ minutes East and continue along said R.O.W. boundary for a distance of 206.7 feet to a point on the East boundary of the West-Half (W 1/2) of said Quarter-Quarter; thence proceed South 00° 36’ East for a distance of 306.8 feet to the Southeast corner of the West-Half (W 1/2) of said Quarter-Quarter; thence proceed South 89° 24’ West for a distance of 510.1 feet to the point of beginning.
SAID PARCEL OF LAND LYING IN THE WEST HALF (W 1/2) OF THE SOUTHWEST QUARTER (SW 1/4) OF THE NORTHEAST QUARTER (NE 1/4) OF SECTION 15, TOWNSHIP 6 SOUTH, RANGE 7 EAST, DEKALB COUNTY, ALABAMA AND CONTAINING 1.80 ACRES, MORE OR LESS.
In accordance with Section 11-42-6 (b) of the Code of Alabama, 1975, a map showing what territory is annexed to the City of Rainsville shall be placed on file in the Office of the Judge of Probate, DeKalb County, Alabama, and the map shall be open to the inspection of the public.
The Legislative Act Numbers 2020-201 and 2020-129 became effective as law on May 28, 2020 when signed by Governor Kay Ivey.
WHEREFORE, this Ordinance shall be recorded in the public records in the Office of the Judge of Probate, DeKalb County, Alabama; and this Ordinance shall be published one time in The Mountain Valley News.
The above and foregoing was read, adopted, and approved on the 15th day of June, 2020 by the Mayor and City Council of the City of Rainsville, Alabama.
