Default having been made in the terms of that mortgage executed on March 25, 2009 by Richard Lee Peppers and wife Christy D. Peppers, to EvaBank, which said mortgage is recorded in Book MTG 1591, Page 311 in the Probate Office of DeKalb County, Alabama, and default continuing, and by virtue of the power of sale contained in said mortgage, the following described property will be sold at public outcry, for cash, to the highest bidder, in front of the Courthouse door of said County, in Ft. Payne, Alabama, during the legal hours of sale on July 10, 2020:
All that part of the SW 1/4 of the SW 1/4 of Section 11, Township 9 South, Range 5 East of the Huntsville Meridian, more particularly described as follows:
Commencing at a concrete monument found at the Southwest corner of the SW 1/4 of the SW 1/4 of said section; thence North 00 degrees 04 minutes 42 seconds East a distance of 352.47 feet to an iron pin set at the point of beginning. From said point of beginning, continue North 00 degrees 04 minutes 42 seconds East a distance of 202.00 feet to a concrete monument found on the Southerly right-of-way (100’) of Alabama Highway #168; thence along said right-of-way, North 65 degrees 03 minutes 47 seconds East a distance of 153.16 feet to a capped iron pin found; thence leaving said right-of-way, South 10 degrees 41 minutes 00 seconds East a distance of 202.00 feet to an iron pin set; thence South 68 degrees 55 minutes 10 seconds West a distance of 189.27 feet to the point of beginning, containing 0.75 acres, more or less, less and except any easements or rights-of-way, and being a portion of the SW 1/4 of the SW 1/4 of Section 11, Township 9 South, Range 5 East of the Huntsville Meridian, DeKalb County, Alabama.
Subject to an existing ingress/egress easement forty feet (40’) in width, lying evenly along, West of and parallel with the East line of the above described property.
