NOTICE OF MORTGAGE FORECLOSURE SALE
DEFAULT HAVING BEEN MADE in the payment of the indebtedness secured by that certain mortgage executed by JOHNNY A. WHITE, an unmarried man, as mortgagor, to LIBERTY BANK, as mortgagee, which mortgage is dated January 10, 2022 and which mortgage was recorded on February 28, 2022 in Mortgage Book 5002, Page 3018 in the Office of the Judge of Probate, DeKalb County, Alabama.
And default continuing, notice hereby is given that under the power of sale contained in said mortgage, I will, on behalf of LIBERTY BANK, proceed to sell on September 16, 2022, during the legal hours of sale, to-wit: 11:00 o’clock a.m. to 4:00 o’clock p.m., in front of the main entrance to the DeKalb County Courthouse in Fort Payne, Alabama, to the highest, best, and last bidder for cash, the following described real estate situated in DeKalb County, Alabama, and described as follows:
A parcel of land described as beginning at a point which is the Northwest corner of the Northeast ¼ of the Southwest ¼ of the Northwest ¼; thence from said point of beginning, run South 00 degrees, 27 minutes East, along the West line thereof, 660.00 feet to the Southwest corner of said Northeast ¼ of the Southwest ¼ of the Northwest ¼; thence run North 88 degrees, 00 minutes East, along the South line thereof, 325.00 feet to a point; thence run North 00 degrees, 27 minutes West, 660.00 feet to a point in the North line of said Northeast ¼ of the Southwest ¼ of the Northwest ¼; thence run South 88 degrees, 00 minutes West, along said North line, 325.00 feet to the point of beginning, containing 4.92 acres, and embracing portions of said Northeast ¼ of the Southwest ¼ of the Northwest ¼ of Section 17, Township 9 South, Range 7 East of the Huntsville Meridian, DeKalb County, Alabama. EXCEPTION: Those portions of above-described lands lying within the right-of-way of Vera Roden Gap Road.
Together with all and singular all the improvements, tenements, hereditaments, rights, members, privileges, and appurtenances thereunto belonging, or in any way appertaining, including all buildings, fences, trees and timber thereon.
Said sale is for the purpose of securing payment of the indebtedness secured by said mortgage, together with the costs of foreclosure.
