NOTICE OF MORTGAGE FORECLOSURE
WHEREAS, default has been made in the terms of the mortgage executed on the 21st day of October, 2019 by Daniel Spurgin, Jr., as mortgagor in favor of Donnie G. Rogers, as mortgagee, as recorded in the Office of the Judge of Probate of DeKalb County, Alabama, in Mortgage Book 2233 at Page 14507, and said default continuing, the mortgagee, under power to sale contained in said mortgage will sell at auction for cash to the highest bidder on the steps of the DeKalb County Courthouse in Fort Payne, Alabama during legal hours of sale on the 1st day of September, 2022, the following described real estate embraced in said mortgage, situated in DeKalb County, Alabama, to wit:
All that tract or parcel of land lying and being in the Southeast quarter of the Northeast quarter of Section 1, Township 4 South, Range 9 East, East of the Huntsville Meridian, DeKalb County, Alabama, and being more particularly described as follows: Commence at a fence corner on the East margin of County Road 779 which intersects the South boundary line of the Southeast quarter of the Northeast quarter of Section 1; thence along the East margin of said road North 20 deg. 17 min. 45 sec. West 48.80 feet; thence North 07 deg. 07 min. 50 sec. West 91.30 feet; thence North 02 deg. 31 min. 54 sec. East 238.92 feet; North 03 deg. 34 min. 51 sec. East 17.89 feet to a point; thence leaving said road perpendicular South 86 deg. 25 min. 09 sec. East 109.81 feet, to a power pole at the point of beginning; thence North 66 deg. 23 min. 03 sec. East 192.66 feet to a tree; thence South 14 deg. 57 min. 39 sec. East 182.99 feet to a ½ inch rebar; thence South 58 deg. 38 min. 16 sec. West 211.42 feet to a ½ inch rebar; thence North 11 deg. 39 min. 09 sec. West 214.05 feet to the point of beginning. Containing 0.88 acres, more or less.
TOGETHER with a 30 foot easement for ingress and egress along an existing gravel drive 15 feet each side of the center. Said easement entering at the Northwest corner of the above described property from County Road
Mortgagee reserves the right to bid on the subject property. Said mortgage is a first mortgage and is not junior to another mortgage of record. Said sale is also subject to unpaid taxes or assessments whether of record or not.
