DEFAULT HAVING BEEN MADE in the payment of the indebtedness secured by that certain real estate Mortgage executed to Liberty Bank by Lukas Swain, an unmarried individual, which mortgage is dated November 3, 2015, and which was recorded in Mortgage Book 2121, Page 62 in the Office of the Judge of Probate, DeKalb County, Alabama; and that certain Mortgage executed to Liberty Bank by Lukas Swain, an unmarried individual, which mortgage is dated October 18, 2017, and which was recorded in Mortgage Book 2218, Page 82 in the Office of the Judge of Probate, DeKalb County, Alabama; and that certain Modification of Mortgage executed by Lukas Swain and Tera Swain, husband and wife, which is dated May 21, 2019 and which was recorded in Mortgage Book 2233, Page 7251 in the Office of the Judge of Probate, DeKalb County, Alabama; and that certain Modification of Mortgage executed by Lukas Swain a/k/a Simeon L. Swain and Tera Swain, husband and wife, which is dated February 19, 2020, and which was recorded in Mortgage Book 5000, Page 2808 in the Office of the Judge of Probate, DeKalb County, Alabama;
And default continuing, notice hereby is given that under the power of sale contained in said mortgages, I will, on behalf of Liberty Bank proceed to sell on February 3, 2023, during the legal hours of sale, to-wit: 11:00 o’clock a.m. to 4:00 o’clock p.m., in front of the main entrance to the DeKalb County Courthouse in Fort Payne, Alabama, to the highest, best, and last bidder for cash, the following described real estate situated in DeKalb County, Alabama, and described as follows:
Commencing at the Southwest corner of the Northeast ¼ of the Northwest ¼ of Section 26, Township 8 South, Range 5 East of the Huntsville Meridian, DeKalb County, Alabama; thence South 89 degrees, 01 minute East 657.0 feet to a point; thence South 89 degrees, 01 minute East 116.6 feet to a point on the Northerly Right of Way of Alabama Highway 79; thence along said Northerly Right of Way, North 53 degrees, 11 minutes, 00 seconds East 216.56 feet to the True Point of Beginning for the property herein described; thence from the True Point of Beginning and leaving said Northerly Right of Way North 27 degrees, 45 minutes, 18 seconds West 122.33 feet to a point; thence North 19 degrees, 32 minutes, 20 seconds West 133.85 feet to a point; thence North 76 degrees, 52 minutes, 05 seconds East 159.99 feet to a point; thence South 36 degrees, 00 minutes, 50 seconds East 184.26 feet to a point on the Northerly Right of Way of said Alabama Highway 75; thence along said Northerly Right of Way, South 53 degrees, 11 minutes, 00 seconds West 202.95 feet to the True Point of Beginning for the property herein described; said lands lying and being in DeKalb County, Alabama. Description taken from that certain survey by Dowdy Land Surveying AL. Reg. No. 18979, dated May 27, 2002.
Said sale is for the purpose of securing payment of the indebtedness secured by said mortgages, together with the costs of foreclosure.
