NOTICE OF MORTGAGE FORECLOSURE
WHEREAS, default has been made in the terms of the mortgage executed on the 9th day of September, 2016 by Orvis LaRay Pringle, a married man, and his wife, Belinda Jean Pringle as mortgagor, in favor of Alred & Compton, LLC as mortgagee, as recorded in the Office of the Judge of Probate of Dekalb County, Alabama, on October 13, 2016 Instrument number 0195230, and said default continuing, the mortgagee, under power of sale contained in said mortgage will sell at auction for cash to the highest bidder on the steps of the DeKalb County Courthouse in Fort Payne, Alabama, on February 16, 2023, during the legal hours of sale, to wit: 11:00 o’clock a.m. to 4:00 o’clock p.m., the following described real estate embraces in said mortgage, situated in Dekalb County, Alabama, to-wit:
Commencing at an 1 inch existing iron marking the northeast corner of Section 16 Township 8 South, Range 9 East of the Huntsville Meridian: proceed S 01 degrees 02 minutes 29 seconds East 1151.94 feet to an iron pin set (with cap ID 23344) on the West right of way of County road 332 (40 foot right of way); thence with said right of way for a chord which bears S 13 degrees 19 minutes 18 seconds W 90.34 feet to an iron pin set ( with cap ID 23344 for a point of beginning; thence continue with said right of way S 09 degrees 06 minutes 29 seconds E 66.57 feet; thence S 45 degrees 02 minutes 54 seconds E 18.81 feet to an iron pin set (with cap ID 23344); thence leaving said right of way S 01 degrees 02 minutes 29 seconds E 1255.57 feet to the center of Chinquapin Creek; thence with center of said creek chords as follows: N 52 degrees 09 minutes 36 seconds W 61.33 feet; thence N 05 degrees 06 minutes 45 seconds W 342.59 feet; thence N 31 degrees 02 minutes 14 seconds W 105.0 feet; thence S 89 degrees 56 minutes 53 seconds W 125.13 feet; thence N 84 degrees 41 minutes 56 seconds W 209.85 feet; thence N 38 degrees 36 minutes 50 seconds W 116.90 feet; thence N 41 degrees 25 minutes 29 seconds W 105.79 feet; thence N 42 degrees 23 minutes 27 seconds E 145.18 feet; thence leaving center of said creek N 56 degrees 45 minutes 44 seconds E 328.45 feet to an iron pin set ( with cap ID 23344); thence N 39 degrees 51 minutes 00 seconds E 300.54 feet to the point of beginning. Containing 8.6 acres, more or less, and lying in the East Half of the Northeast Quarter of Section 16, Township 8 South, Range 9 East, Dekalb County, Alabama.
Said sale is made for the purpose of foreclosing of said mortgage, paying the mortgage debt, the costs and expenses of foreclosure, including a reasonable attorney’s fee.
Mortgagee reserves the right to bid on the subject property. Said mortgage is a first mortgage and is not junior to another mortgage of record. Said sale is also subject to unpaid taxes or assessments whether of record or not.
