MORTGAGE FORECLOSURE NOTICE
DEFAULT HAVING BEEN MADE in the payment of the indebtedness secured by that certain mortgage executed by Magnolia Company, LLC, to Leslie Jane Matthews Bunch and Jim Bunch which mortgage is dated July 11, 2022, and which was recorded on July 12, 2022, in Mortgage Book 5002 Page 11973 in the Office of the Judge of Probate, DeKalb County, Alabama;
And default continuing, notice hereby is given that under the power of sale contained in said mortgage, I will, on behalf of Leslie Jane Matthews Bunch and Jim Bunch proceed to sell on July 12, 2023 during the legal hours of sale, to-wit: 11:00 o’clock a.m. to 4:00 o’clock p.m., in front of the main entrance to the DeKalb County Courthouse in Fort Payne, Alabama, to the highest, best, and last bidder for cash, the following described real estate situated in DeKalb County, Alabama, and described as follows:
A tract or parcel of land containing 5.86 acres more or less located in the SE Quarter of the SW Quarter of Section 29, Township 5 South, Range 10 East, DeKalb County, Alabama, and being more particularly described as follows: commence at the NE corner of said quarter quarter; thence S° 68 46’27” W 1113.56’ to an iron set, (this and all irons hereafter referred to as “set” are 1/2” steel rods with yellow cap stamped “Owen 27400”), the point of beginning; thence S 21° 21’38” W along a fence line 327.90’ to a 1/3 pipe found; thence S° 75 57’03” E (record S 72 E) along a fence 37.’0′ (record 37”) to a fence corner; thence S° 21 21’38” W (record S 18 W) along a fence 130.18’ (record 130’) to a fence corner on the north ROW limit of Mountain Street; thence along said ROW limit N 71° 21’04: W 581.31’ (record N 72 W 584’) to an iron set; on the east ROW limit of Alabama Great Southern Railway; thence along said ROW limit N 26° 39’00” E (record N 22 E) 510.79’ to a railroad spike in asphalt; thence leaving said ROW limit S 65° 26’17” E 497.35 to the point of beginning.
Subject to a 30’ non-exclusive easement for ingress, egress, and utilities, the centerline of which is described as follows: beginning at a point which is S° 09 02’59” E 10.96’ from the intersection of the East railroad ROW and the East ROW of Railroad Street; thence the following chord bearings and distances along said centerline: N 40° 05’16” E 25.37; N 43° 27’34” E 38.97’; N 67° 51’39” E 42.68’; N 24° 24’12” W 23.96’; N 01° 38’58” W 33.76’; N 32° 41’35” E 27.86’; N 68° 11’06” E 31.74’ to the end of said easement.
Also subject to any existing easements or right of ways recorded or unrecorded.
Said sale is for the purpose of securing payment of the indebtedness secured by said mortgage, together with the costs of foreclosure.
