MORTGAGE FORECLOSURE NOTICE
DEFAULT HAVING BEEN MADE in the payment of the indebtedness secured by that certain mortgage executed to Liberty Bank by Mark Paul Ford and Mark Ethan Ford, an unmarried man, which mortgage is dated July 7, 2016, and which was recorded on August 16, 2016 in Mortgage Book 2156, Page 89 in the Office of the Judge of Probate, DeKalb County, Alabama; and default continuing, notice hereby is given that under the power of sale contained in said mortgage, I will, on behalf of Liberty Bank, proceed to sell on September 6, 2023, during the legal hours of sale, to-wit: 11:00 o’clock a.m. to 4:00 o’clock p.m., in front of the main entrance to the DeKalb County Courthouse in Fort Payne, Alabama, to the highest, best, and last bidder for cash, the following described real estate situated in DeKalb County, Alabama, and described as follows:
Beginning at the Southwest corner of the Southeast ¼ of the Northeast ¼ of Section 30, Township 8, Range 8 East, and run North 05 deg West 80 poles to a stake; thence North 85 deg East 10 poles to a stake; thence South 75 deg 30 minutes East to U.S. Highway No. 11; thence in a Southwesterly direction with said highway to a lane at the Southeast corner of what is known as Alma Stewart 4 acre tract 4g; thence in a Westerly direction to the point of beginning, less and except a tract conveyed by W.S. Garrett to B.S. Nowlin and particularly in Deed Book 100 at page 142, Office of the Judge of Probate, DeKalb County, Alabama. Also, less and except a tract conveyed by W.E. Stewart and wife, Alma Stewart to Harvey Ford and wife, Jo Ann Ford which conveyance is recorded in the Office of the Judge of Probate of DeKalb County, Alabama. Containing 15 acres, more or less here conveyed, being the West part of the Southeast ¼ of the Northeast ¼ and the Northwest part of the Northeast ¼ of the Southeast ¼ of Section 30, Township 8, Range 8 East and being all in what was formerly known as the W.S. Garrett farm lying West of Highway No. 11. Whether or not correctly described herein the mortgagor and mortgagee intend that the property herein conveyed is the property with parcel number 27-09-30-0-000.020 in the records of the DeKalb County Revenue Commissioner.
At the time the mortgage on the above-referenced property was executed, the property was not the homestead of Mark Paul Ford, or his spouse, if any.
Said sale is for the purpose of securing payment of the indebtedness secured by said mortgage, together with the costs of foreclosure.
