NOTICE OF AUCTION
Under and by virtue of a judgment in the above styled cause rendered by Circuit Judge Shaunathan C. Bell, the following real property shall be sold at public auction on Wednesday, March 1, 2023 at 3:00 p.m. to the best, highest and last bidder:
Beginning at the Southwest corner of Lot 10 in Block 19 of the Cave Addition to the City of Fort Payne, Alabama as shown and recorded in Plat Book 1, pages 56-57 in the Office of the Judge of Probate in DeKalb County, Alabama, run North 36 degrees 31 minutes 10 seconds East with the Westerly boundary line of Lots 8, 9 and 10 in Block 19 , also being the Easterly right-of-way line of Lincoln Avenue for 95.30 feet; thence leaving said right-of-way line run South 54 degrees 12 minutes 40 seconds East for 117.50 feet to a point on the Easterly boundary line of Lot 8; thence run South 36 degrees 31 minutes 10 seconds West with the Easterly boundary line of said Lot 8, 9 and 10 for 98.75 feet to the Southeast corner of Lot 10; thence run North 52 degrees 31 minutes 15 seconds West with the Southerly boundary line of said Lot 10 for 117.50 feet to the point of beginning. Said property being lots 9, 10, and a part of Lot 8 in Block 19 of the Cave Addition to the City of Fort Payne, Alabama and is subject to all exceptions and reservations of record.
Personal property, including bedroom furniture; grandfather clock; oil lamps; tables and chairs; upright freezer; decorations and other items, will be auctioned “As Is”.
The Auction will be conducted by Auctions United, Inc. in conjunction with Wilson Realty of Fort Payne, Alabama. The auction will take place on the property at 707 Lincoln Avenue SE, Fort Payne, AL (corner of Lincoln Avenue and 8th Street SE).
Terms – Real Property: 10% Buyer’s premium will be added to the final bid and due the day of the sale. The balance will be due at closing and within 30 days from final court approval.
Terms – Personal Property: 10% Buyer’s Premium will be added to each final bid. The total amount will be due the day of the auction. Removal of purchased items is the responsibility of the Buyer. Cash or personal check accepted. No credit or debit cards accepted.
